Accept Terms and Conditions (one-off)

Welcome to the Department of Agriculture and Water Resources (Department) External Team Site.  The External Team Site is designed for the Department’s staff to discuss, consult and collaborate online with external clients and stakeholders, such as industry, non-government agencies, state, territory, Australian government and other external users both within Australia or overseas, through a shared workspace.

Access to the External Team Site is via invitation only from the External Team Site Administrator and requires a username and password for each member.  Access is granted to authorised users only.  All activity undertaken using a particular username is considered to have been undertaken by the individual assigned that username. 

The Department provides use of the External Team Site subject to the following terms and conditions.  Please read them carefully.  By clicking on the “I agree” button below, you agree that you have read and understood the terms and conditions and that you agree to be legally bound by them.  Alternatively, by clicking on the “Cancel” button below you will be automatically logged out of the External Team Site.   


1. What this agreement covers

This is a legally binding agreement (Agreement) between you and the Commonwealth of Australia represented by the Department of Agriculture and Water Resources (Department) for access and use of the External Team Site.

2. Definitions

2.1 The following words have these meanings in these terms and conditions (Terms) unless the contrary intention appears:

  1. APS Code of Conduct and Values means the standards of behaviour and values which are set out in the Public Service Act 1999 (Cth).
  2. External Team Site Administrator means the Department employee who is responsible for the relevant External Team Site(s) you have access to by providing you with a username and setting user permissions to the sites.
  3. External Team Site means the online team collaboration application through a shared workspace via invitation from an External Team Site Administrator to external users.
  4. Internet and Email Usage Policy means the Department's internet and email usage policy which can be accessed on the department's intranet.

3 Use of External Team Sites – Your Responsibilities

3.1 You must not:

  1. let any other person use your username and/or password;
  2. transfer or disclose your username and/or password;
  3. post information (for example, names, addresses, telephone numbers, etc.) that may be used to identify a person who is not a user on the External Team Site without that person’s consent;
  4. store or transmit information that is classified protected, confidential, secret, top secret or has the dissemination limiting marker (DLM) sensitive: cabinet;
  5. make information you have obtained from an External Team Site available to persons who are not registered users of the External Team Site;
  6. use the External Team Sites to post any materials and/or links to any material which is false, inaccurate, defamatory, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, is an invasion of a person’s privacy or otherwise in breach of any law;    
  7. infringe the intellectual property rights of any third party by posting material on the External Team Site; and  
  8. post any copyrighted material on the External Team Site without the express permission of the copyright holder unless the copyright is owned by you or is licensed to you.  

3.2 You agree to:

  1. keep your username and password secure;
  2. only upload documents to the External Team Site for the purpose of enabling the members of the External Team Site to share information in an on-line collaborative environment; and
  3. accept responsibility for all activities that occur under your username or password.

3.3 You acknowledge and agree that:

  1. the Department or the External Team Site Administrator (where applicable):
    1. may track all your activities on the External Team Site for auditing purposes;
    2. may monitor, edit or remove content posted on the External Team Site for any reason at any time; and
    3. may vary these Terms at any time and that your continued use of the External Team Sites after a variation will constitute your acceptance of the Terms as varied;
  2. by posting material on the External Team Site, some of your personal information such as your name, e-mail address and any other personal information you include in your posting may be made public.

3.4 Information available to you on the External Team Site should be treated as confidential information and must not be disclosed to anyone without permission from the Department and/or the External Team Site Administrator.

4 Australian Public Service (APS) Users Responsibilities

  1. All APS users must comply with the Department’s Internet and Email Usage Policy when using the External Team Site.
  2. You acknowledge that you have read and understood the Department’s Internet and Email Usage Policy.
  3. All APS users must comply with the APS Code of Conduct and Values in relation to the use of the External Team Sites.
  4. You acknowledge that inappropriate usage of the External Team Site will be reported to the Department and action will be taken in accordance with the APS Code of Conduct and Values and the Department’s Internet and Email Usage Policy.
  5. You must comply with all directions from the External Team Site Administrator regarding the use of the External Team Site.

5 Non APS Users Responsibilities

  1. You must not attempt to download or install unauthorised software onto the External Team Site.
  2. You must not store or transmit information that is confidential on the External Team Site.
  3. You must not use the External Team Site to promote or conduct a private business.
  4. While using the External Team Site, you must not allow another person unsupervised access to a computer that you are logged into.
  5. While using the External Team Site, you must not leave a computer that you are logged into unsupervised unless it has been locked. (f) You must comply with any procedures, work instructions and all directions from the External Team Site Administrator regarding the use of the External Team Site.

7 Disclaimer

7.1 You acknowledge and agree that:

  1. to the extent permitted by law:
    1. your use of the External Team Site is at your own risk;
    2. the Department and/or the External Team Site Administrator makes no representations or warranties express or implied regarding the download, installation, operation, upload or effectiveness of the External Team Site or any software used to access or operate the External Team Site, including interaction and compatibility with other aspects of your computer system;
  2. any message posted on the External Team Site expresses only the views of the author of the message and is no way intended to reflect the views of the Department;
  3. neither the Department and/or the External Team Site Administrator will be held responsible for the contents, currency, accuracy, completeness or validity of any information posted on the External Team Site;
  4. you may experience interruptions and errors in using the External Team Site and neither the External Team Site Administrator, the Department, or any of its service providers, licensors, employees or agents warrant that the External Team Site will be uninterrupted or error-free; and
  5. the Department and/or the External Team Site Administrator makes no representation or warranty as to the security of the information contained on the External Team Site.

7.2 The Department and/or the External Team Site Administrator will not be liable for any damage you suffer:

  1. arising from or in connection with the External Team Site;
  2. arising from or in connection with any software used to access or operate the External Team Site, or their download, installation, use or performance;
  3. as a result of accessing, using or interacting on the External Team Site;
  4. as a result of your reliance on the information obtained through the External Team Site;
  5. due to unavailability of the External Team Site and/or events beyond the Department’s or the External Team Site Administrator’s control such as but not limited to internet connection or reconfiguration of the External Team Site;
  6. due to inaccuracies, omissions, errors regarding content on the External Team Site; and
  7. due to loss or corruption of data held on the External Team Site.

8 Indemnity

You agree to indemnify the Department, the External Team Site Administrator, the Department’s officers, employees, agents, contractors, service providers and licensors from and against all actions, claims, demands, costs (including all reasonable legal costs), losses, damages and expenses, whether direct or indirect caused by, as a result of or in connection with:

  1. the External Team Site;
  2. your use of the External Team Site;
  3. your failure to comply with your obligations under these Terms;
  4. the transmission of any material that you upload on the External Team Site;
  5. any act, error or omission by you, including in relation to incorrect, incomplete or misleading information;
  6. you libelling or defaming any person or Government department;
  7. an invasion of privacy; or
  8. you breaching any applicable law.

9 Termination

The Department and/or the External Team Site Administrator reserves the right to refuse access and terminate your account for any reason at any time. The termination of your account is a termination of this Agreement.

10 Survival

You acknowledge and agree that clause 7 (Disclaimer) and clause 8 (Indemnity) survive:

  1. the termination of this Agreement; and/or
  2. your discontinued use of the External Team Site.

11 Governing Law

This Agreement will be governed by and interpreted in accordance with the law in the Australian Capital Territory.
